Who Needs An Estate Plan?

People often ask me how old a person should be or how much money they should have to need an estate plan. My answer is always the same: estate planning isn’t just about leaving money or assets; it’s about naming people to take care of you and make decisions when you can’t. Anybody over 18 needs an estate plan. While estate planning is often associated with older individuals or those with significant assets, it’s essential for adults of all ages. Here’s why:

  1. Asset Distribution: Even if you don’t consider yourself wealthy, you likely have some assets, whether a car, savings account, or personal belongings. An estate plan ensures that your assets are distributed according to your wishes after your passing.
  1. Medical Decisions: Estate planning includes documents like a living will and healthcare power of attorney, which outline your preferences for medical treatment if you cannot communicate them yourself. This is important for unexpected accidents or medical emergencies.
  1. Financial Management: In case of incapacity, an estate plan can designate someone to manage your finances and make financial decisions on your behalf. It can be crucial for paying bills, managing investments, and ensuring your affairs are in order.
  1. Minor Children: If you have minor children, an estate plan allows you to name a guardian who will care for them in the event of your death. Without a plan, the court will decide who takes custody, which may not align with your wishes.
  1. Avoiding Probate: Proper estate planning can help your loved ones avoid the lengthy and costly probate process, allowing for a smoother transfer of assets after your death.

Overall, having an estate plan provides peace of mind, knowing that your affairs are in order and your loved ones are provided for according to your wishes. It’s best to consult an attorney who practices exclusively in estate planning to ensure your plan is comprehensive and legally sound.
